Florida lawsuit alleges unfair and deceptive practices in the sale of timeshare upgrades

ORLANDO, Fla.--(BUSINESS WIRE)--The Finn Law Group P.A. has filed a class action lawsuit on behalf of timeshare owners at Festiva’s Orlando Resort, formerly known as Celebration World Resort, alleging that the resort’s developers and managers have engaged in unfair and deceptive practices in the sale of timeshare upgrades and reservation point allocation.

The class action lawsuit, Reeves, et al. v. Zealandia Holding Company Inc., et al., cause no. 13-CA-866-MF, was filed March 1 in the 9th Judicial Circuit Court of Florida, in Osceola County.

The suit alleges that, beginning in 2004, approximately 900 parties purchased timeshare interests in Celebration World Resort Owners Association, located in Kissimmee, Fla., from B.L. Vacation Ownership Inc. Between 2008 and 2011, representatives of B.L. Vacation Ownership sold upgrades to existing timeshare owners that would increase the number of points they had to apply to timeshare reservations.

Money taken

I need to know how to cancel my timeshare with festiva they are a disgrace. I have paid out my *** and still havent been able to go a vacation because you have to go when they have something avaiable. I have tried to stay at some places but i cant get a bigger room. I can only use a certain amount of my points. They told me I could use all my 10,00 points at one time. I would get a free vacations in Flordia. Well they are buig fat liars. I want to cancel or I will stop the payments. Either way they wont get no more money.

Well wonders never cease, today I received a check from Festiva for the amount of maintenance fees I did not owe. I am happy about this, they did the right thing.

BUT i'll never get involved again with any timeshares.

Well this has been an interesting week of e-mails back and forth with Festiva. First they told me that if my contract was completed by 1-1-2013 i would not have to pay any maintenance fees for 2013.

So my contract was competed on Dec. 2012, great I get my money back. HOLD ON, Yes Festiva got that money and applied it to the new owners account instead of returning it to me, THATS FAIR RIGHT? They told me Pacific sent them a check, then it was Grey Wolf Transfers Inc.

that sent the check, they are all the same crooked company, same address , same building, same town in Calif, and so on. Then I was told Pacific Transfer had to pay me, funny, Pacific dosen't have the money anymore but trying to get them to respond is like going to the moon. So they all lie and it's all about the money so when you see them post it's just to cover the rear end and make them look good. IT'S ALL ABOUT THE MONEY, *** ON YOU.

SHAME ON THE TIMESHARE INDUSTRY AND ALL THE RELATED COMPANIES.

NEVER DEAL WITH ANY OF THEM THE INDUSTRY IS A BIG JOKE ON YOU, THEY LIE TO YOU AND TAKE YOUR MONEY AND THEN WITH ALL RESPECT HOLD YOUR FAMILY HOSTAGE FOR THE ENTIRE LIFE OF THE EARTH, THEY WOULD FOLLOW YOU TO *** OR HEAVEN IF THEY COULD JUST TO GET THE WHAT? MONEY.

Ok, I have sent you an e-mail with the information I think you will need to investigate this matter. My account with Pacific was closed on Dec.

13, 2012 they stated that I was no longer an owner. SO if your statement is correct Festiva owes me the 2013 maintenance fee of $236.63.

On 1-16-2013 R.C.I. sent me a letter stating that my account with them had been cancelled.

So Festiva had notified them some time between 12-13-2012 and 1-16-2013 to cancel my account.

SO I lost all my banked time thank you. I have issues with all of them.

Had points banked to RCI from Celebration World in 2012. I hired Pacific Transfer to get me out of that timeshare. Festiva purchased Celebration late 2012. Pacific Transfer told me that I had to pay 2013 maintenance fees or the transfer would not happen. In Nov. 2012 I paid the said fees to Pacific ( for a timeshare i din't own)and they where to pay that money to Festiva. Festive cancelled my account with RCI ( which I paid for) and I lost all my banked points. Now Festiva said they didn't get the maintenance fees, Pacific Pransfer cannot seem to find if they did in fact pay or not, you wait 30 + min to talk and get put automatically on a message port to have them call back. over three weeks and still no one know anything. RCI just keeps telling me Festiva canceled my account, and around and around we go and where we stop ,no one knows. MY ADVICE TO YOU ALL NEVER GET INVOLVED WITH ANY OF THESE PEOPLE, AND NO ONE WILL HELP, YOUR ON YOUR OWN AND YOU LOOSE, ALWAYS. SAVE YOUR MONEY. PAY AS YOU GO.

pretty site but it stinks. I want to book a reservation and cannot get to your "secure" site or any site to book or even look up what is available. information states to call a number or book on the web, but no listing of where that is. Please make it more user friendly. Last time we tried this it was just as bad. Also couldn't find a place to stay even at 2 months out. Not expecting much this time either. Where can I find out what dates are available. Nothing more to say, am I not done with my 100 words?

Are you a Festiva Adventure Club Member if so if you have the 2012 or 2013 book look at the resorts then manually type in their names on your browser and look them up some of them are even on expedia. You can get the review results and see what the resort looks like then call cust serv and give them dates to look at for you.

I did that with my very first reservation which I made on 34 days before I was leaving although I only go to Orlando. I got Lake Buena Vista it was a nice resort small to look at the Towers they look like a hotel but are actually Condos the problem is Blue Heron Beach Resort is not owned or managed by Festiva so the availability is much less which I found out through the Corporate Office. Check all resorts you are interested in find the reviews if you can. It can tell you a lot about the resort.

Even though I got my reservation and have another mid week resevation scheduled at the same Resort there are some major problems I have with this company that i have not been able to get resolved so I have a complaint that I filed with the NC Atty General's Office. I know now i should never have traded my week for the points but week availability is dwindling with RCI most resorts are changing to the point system it was much easier when they were not.

If you own points at a specific resort do not join the Adventure club because the maintenance fees are astronomical and they will make you pay extra for the conversion as well. I am beginning to think I could have rented a condo without all the problems with out changing within Festiva.

Many Broken Promises

When we originally purchased time share at this Festiva location, we were promised many things, most of which turned out to be misrepresentations. Part of sale, was a golf package, which when we tried to use it, were escorted by security back to unit and threatened with eviction if we attempted to use it. Original sales man and supervisor promised we could any week, except July 4th-we later discovered we could only use few weeks in spring and fall. Another time, we were given a $100 Visa card, where no funds were ever entered- a usual occurrence, per bank rep. handling the card. Festiva rep. said this was a 'usual thing". When asked why, rep wouldn't answer. Don't waste your time and money on this disreputable company.

Festiva Crime Wave

We were sold a time share understanding that the maintenance fee is Bi annual first year we tried to use it we were told no availablity all year. Come to find out the Bi-annual maintenance also means you can only use it every other year. I am PISSED, I hate every fiber of this company. Dealing with them make me feel like I talking to the Mob and in my heart I believe they are a part of organized crime. We've tried the Travel Commission for the State of SC and gotten no results. We also filed countless reports to the BBB nothing has stopped this Cancer Company from cheating more people out of hard earned money.

How can We book with anyone when you are hatching plans to deplete our points? How can we have 120,000 points for years (sold to us via a contract) only to be told that your company is evaluating the initial points distributed and you feel we were given too many!

Come on! This is fraud plain and simple. When you acquired Celebration World Resort did you not read the contracts with the current owners? If the contracts were so incorrect then why did you make the purchase?

Why didn't the REAL ESTATE LAWYER wave the red flag and put a stop to it? Festiva-you need a big hefty lawsuit!

I just realized that Festiva has screwed a lot of people out of their points. Points that were sold to us and approved through a lawyer!!!

We need to get legal action going against Festiva. I agree with you Deb in that Festiva purchased a company and can't after the fact correct their own mistakes at our expense!! Please if someone is heading up a class action suit of some sort please email me.

Nevermind trying to book something....what about the fact that Festiva is correcting a probelm they purchased at our expense!! How can Festiva take points away from us owners who purchased them through a legal process. When Festiva purchased Celebration World Resort they should have looked at the contracts at that time and then decided whether it was a good business decision to purchase....NOT rely on screwing all the owners out of their points.

Fees

We were told we had to have paid our maintence fees for the year. At the time we signed the contract, we had.

They took so long to process it (months) that we wound up owing another year's maintenance fees to the tune o $552. They they had the nerve to tell us we had to pay travel club dues for another year, when I obviously did not intend to travel if I sold the timshare, and that was another $175.

So, we are out an extra $727 plus what we paid at the presentation. Don't buy a timeshare.Pay for hotels.

Trying to sale back my time share

I called Festiva to get them to sale our timeshare. My husband was out of work for 8 months and I have been out for 3 months.

I was told that they don't have a resale department and I would have to sale it myself. I'm not a sales person and they should protect their interest. We also received letters stating our maintenance fees were going up 200 for upgrads. I never asked for an upgrade.

We have not been able to use this timeshare at all but they still deduct the monthly payment. I would never buy from Festiva or any other timeshare.

Although FAC is not involved in the resale of ownership or membership interests, all owners have the ability to do so either on their own or through a resale service or realtor of their choice. The website for the American Resort Development Association’s website, www.arda.com, offers advice on finding a resale company and a resale checklist that may help you get started.

Your reference to an increase for upgrades was not related to your annual maintenance fee but was a one time fee charged to all members of FAC. This special assessment fee was paid directly to resorts where the club holds inventory for the use of its members. Had the club failed to pay this fee, which was billed to the club by various resorts, members would have been unable to use those resorts.

Our Finance Department may be able to assist you with alternative payment plan options to help avoid delinquency and default. Mislead

I too am very upset with this "Festiva and now Summerwinds." They have repeatedly lied to us, increased our maintenance fees, attempted to try to sell us points and then a membership to Summerwinds. Each time, they want another $6000. Our original paperwork says "Festiva/Summerwinds, but there is alway another gimmick that they want to try to sell us." They are greedy when it comes to everything. Right down to charging you $25.00 for internet. Any cheap hotel gives you free internet.These people need to be stopped. The last time that Summerwinds spoke to us, they were telling us that everything they agreed to is now void. It wasn't void on our part, but now they do not honor what they signed as a legal document.

Accused of attending a group presentation!

We was invited to attend a presentation at the Myrtle Beach South Carolina location and was very unhappy.We were accused of being down their with a group, however that was incorrect. We explain in detail that we didn't know of the person/people that we was accused of being with. I will NEVER visit Festival in South Carolina again, and will never send anyone to that place either. They are label as unprofessional what to be workers their with no sense of HUMOR at all.My credit card was charge 150.00 as well. By any means if we were with a group,why did they let us attend the presentation.I am contacting the BBB and filing a complaint again this company.I will dispute this and take it as far as I can and make sure some employer their go back to some type of training.

Based on information obtained at check in, you arrived with two other families. Although one of the couples you arrived with claimed you did not know each other, the second couple indicated you had all traveled together. Prior to arriving at the resort, each of you received a confirmation letter indicating the following:

Offer valid one per family only.  No groups consisting of more than one (1) couple traveling together is permitted. 

If you do not qualify or attend the tour you will be charged a $250.00 accommodation fee or total cost of room, whichever is greater and will not be eligible for offered items.

Salesmen liers, and spanish speaker superviser very disrespectful

They lied to us, they sold us a week in a resort in a different place, that we were interested, then they gave us a week in a place for $ 500, we paid $800 for the week, the rob us $ 300, and don't want to give our money back in any way, beside that they treat me very bad!!! We are just asking for justice, some kind of incentive, something that make us feel that we money is back, some another days in another place, some park tickets, anything, but they say NO!!!! We believe in their words when they were selling, and now we feel that they are robbing us just in front of our faces, is not fair, our only vacation in the whole year are totally ruined.

DON"T do any buisness with Festiva. They will promise you the world and leave you high and dry.

Read every word of the fine print. Sales people have no compunction about lying.Hard to get out of their presentation Too many conditions Dog and pony show. Restrictions on weeks available. Limited locations Very hard trying to make a reservation and when you try , you get no response.

They will show you an upgraded model and you will end up in a slum. Beware beware. Wish that we had never heard of Festiva.

Buyer beware. No matter what they offer you to sit in a presentation,DON"T DO IT

Our company has sent over 100,000 families on vacation in 2012 alone. We are a reputable business with nearly 75,000 owners and members. The offers are made to qualifying individuals premiums in exchange for attending a 120 minute presentation. No purchase is necessary and individuals are not required to make a purchase or continue the presentation past the 120 minute requirement in order to receive these premiums.

We offer 24 locations and have renovated or are in the process of renovating many of our resorts. Members have the ability to request renovated accommodations when booking their reservations; however, all reservations are filled on a first come, first served, space available basis.

Beware of the promotions you receive from Festiva!!!

I received a promotion from Festiva by mail about attending their presentation for 1.5 hrs to 2 hrs max. and then receive an Android tablet without having to purchase anything. Here is how it went, the 2 hrs turned to 4-5 hrs with enormous amount of pressure. they present to you a 29 thousand dollar vacation package that would otherwise cost you 40 thousands. And if you reject that package, they will come back with another and another. They drill you to death trying to make you sign right there. And here is the kicker, they claim the Android tablet costs $400!!! What a crock of *** When I received this piece of ***, I realized how antiquated it is, Android 2.2 without the ability to upgrade it. This thing costs brand new $69. But guess what, it is refurbished and did not charge after the 2nd time. The customer service for this piece of *** is full of more *** They were supposed to send me another charger a month ago that has never arrived and I could not get a response from the so called customer service inquiring about the charger. Festiva bought these refurbished products in bulk. So they probably spent no more than $20 on the tablets. Then they lie to you and claim this product costs $400. This is only the beginning of the lies. What happens when you really fall for the purchase of their b.s. package. People that was a COMPLETE waste of time. Spare yourself form wasting your time. Believe me!!!

We went to the 1 hr 57 min presentation. It was pleasant, & everybody was professional.

I got the tablet & gave it to my children. They didn't say it cost $400. What they told us is that the average they spend to get people to come is $400 per couple when you include the gift, advertising, marketing, etc.

The tablet is a $250 tablet online. We were very happy with it & it works great.

:( The gifts Festiva promises you are worthless. It's been over 30 days and my husband and I still haven't received our $50 Visa card.

We received a worthless piece of *** video camera, and a "dining dough" certificate where we would have to spend $50 to get $50 worth of free food, plus 20% tip. It's not a straight up certificate. We were told that the Visa website was "down" and we wouldn't receive our $50 Visa. We paid $80 to stay at a *** Howard Johnson's.

That was Sept. 2, and still no $50 Visa card. We've called about 10 times, and every time we are told "it's been mailed," then it's been fed'x'd, overnight even, and yet we still have no card. We told them to cancel our vacation week that we purchased, and wanted our $155.00 back.

Now the sales manager says we should have written a letter. WHAT??? FESTIVA breached the contract by NOT giving us the $50 gift card. The contract is void.

Now off to report to the BBB and the Attorney General. Really, if this is how FESTIVA treats customers before you even vacation with them, DO NOT WASTE YOUR TIME OR MONEY!!!

At least Festiva could've offer something uptodate to live up to their claim! That is NOT a $400 product.

I won't even spend $40 on it. I am not exaggerating either.

I have an appointment with Festiva tomorrow. So glad I read these reports before I bothered to drive 2 hours away to receive a promise for *** merchandise after a 4 hour presentation and harassment to purchase something I would also never receive.

I can already see that this company does not hold to their word and I will spread the word. Their "sweepstakes" to win a new car or $24,000 are up all over the mall and at the dealership where I purchased my car.

Glad I did not fall for this scam!!! :(

Wasted my time

I received a phone call stating I'd won a grand prize either vacation in Florida, 26" TV or $25,000. To redeem I had to attend a 2 hr presentation at Festiva Blue Ridge in Banner Elk, NC. The person that called asked if I was married and I said no I'm separated and that my relationship status had changed since I supposedly entered their drawing. She asked if my income was over $55,000 annually and if I was over 28 years old. I said yes to both which according to her made me eligible to attend the presentation and receive one of the grand prizes. So an appointment was made for my presentation. When I arrived for the presentation the lady at the desk asked if I was married. I said no I'm separated. Well she said my husband had to be with me to do the presentation. I told her that the person on the phone told me I was eligible to attend. The lady at the desk said no I had to be legally separated or divorced. So I was given a toll free number to call to talk with a manager and that if the original person on the phone misrepresented the terms I would be sent a scratch off ticket to determine which prize I'd won. I called the toll free number from the parking lot of the resort and spoke with a manager. She stated she would go back and listen to the original recording and would call me back by 6 PM that day. Well that was last Friday and I've received no phone call and nothing in the mail. A huge waste of my time and energy to drive to Banner Elk and deal with these inept people. So to anyone who hasn't had the timeshare experience they are a black hole that will suck you dry with maintenance fees and special assessments, been there, done that, not doing it again. So actually I'm feeling fortunate that I didn't have to sit through their 2 hrs of *** to receive my 'grand prize'. At least, Wyndham Resorts honored their freebies for sitting through the presentation. I'll be staying away from Festiva since they can't even return a phone call. And my suggestion to anyone else is to use extreme caution if you decide to deal with these folks.

I agree with the above evaluation and will add the company called 'Grand Resort Travel' in Asheville, NC. Total waste of time and money.

We joined last May and have had NO success for our requests. And the 'gifts' were full of holes so we didn't get any of them either! Hope no one else falls for these people!

Wish we could get our money back! :(

I received a follow call from a Festiva representative about 3 weeks ago apologizing for the apparent miscommunication. She said that they have a marketing company handling the initial contact and there have been some problems.

She informed me that they are not permitted to mail out the scratch off tickets so I was misinformed by the person at the resort. The Festiva rep that called me offered to send me a $50 prepaid Visa card to cover my expense for driving to the resort. Well you guessed it.....I haven't received that either.

So I'll reiterate my suggestion in the first posting - use extreme caution if you plan to deal with these folks. Or better yet, don't waste your time.
